That is something completely irrelevant. The problem here is that when you use custom names, the emoticons in other people's names don't show up. When you don't use it, you see the emoticons.
There's nothing illegal about this, and has also nothing to do with modifying the exe. The problem is that when you use this feature, Plus! replaces the email address with the custom name. Therefore, Messenger will think that it's showing your contact's email address, and as email addresses cannot contain emoticons, it won't show them.
This is considered a limitation and cannot be fixed.
