It would require a program on their computer, but if they don't agree then there's nothing you can do about that.
So far, I don't know if there's something like that for MSN Messenger or Messenger Plus!, or if it can be done.
While the intentions or the final result might not be illegal, if you don't want them to know it is illegal.
And since, you don't want to ask them, I assume you want them to show their webcam status without their consent.
Btw, Yahoo! IM gives you the option not to show you're using the webcam.
