It works
because of a flaw in Internet Explorer. It should not be working at all, since an mp3 file is not a picture. everything in an img tag should be interpreted as a picture, if it is not a picture (gif, jpg, png) a red cross should have been shown.
This isn't because ActiveX....

And that is indeed how the vast majority of the web users feel like. Background music is in 99,99999999% of all cases very annoying. (especially when the loop is infinite and when the sound is that loud as on your msn spaces blog!!!!)
