I really like it but i have a problem im using tab chats and there is the blue colour where is files etc would it be possible to change this colour so that it fits to the others (like it was in MSN 8,5)

i have a question how do you insert your own pictures as a background

in your msn skin

You have to use the script for it which you can download with this skin.

but now i still don't understand how to insert a picture

It is not a bug, you have just to set the conversation background as "None" instead of "My Picture #" in the option panel.
