That's the whole point...
It is not the same!! If the program you use to chat doesn't have a log-system then logging/copying/storing is illegal (in those states)!!! Of course the other person doesn't know that you do this, but again, that was the point in that lawsuite... The guy from who the chat was logged by the police was arrested and the log was used as evidence... read the full article
