Indeed, but if the name is so similar that it could cause easy confusion. I've heard of cases where your existing copyright can be so close to someone elses, that was made after, that you have grounds for a lawsuit, however as I said before I don't know where the law stands on this for sure.
For example I couln't make a company called Mikrosoft, due to the fact that Microsoft would see it as an obvious rip off.
