There's nothing which brings any kind of "responsibility" for updating this skin to the creator. Of course, it'd be great if he could keep this skin working on the latest version, but keep in mind that as far as I know, nobody's getting paid for releasing skins for free. Most of the people here have other projects/work/real life activities to do other than making skins. Skinning takes a long time to get it right, especially for major version increases (8.5 to 9.0 / 14.0 / 2009) so either you just wait or you do it yourself!
Yes, this skin has won a prize in the skinning competition, and then what? The winning project in the scripting competition was Screenshot Sender, and matty still hasn't been able to update it simply because he has many other things to do. It's not because you create something, that you're explicitly obligated to maintain it forever!

Patchou creates Messenger Plus! Live, he builds the skinning functionality but he doesn't create them. He organizes skinning contests but he's not the boss of the skinning creators (I hope?

Seriously, even if you had a petition signed by millions of people to get this skin updated, Volv probably still has other things he has to do. The Windows Live Messenger team gets paid to develop Messenger, but Volv doesn't get paid for making this skin.
