most likely, although the new cases (pointed out by mwe99) also most likely void the warrenty though! A warrenty is very strict in such cases, anything changed will break the warrenty; if you want a new case you have to go to the store were you purchased the PS2...
But no, it is not illegal to mod your case in that way...
It would indeed be illegal if you mod the PS2 itself, with chips to crack games and stuff.
